Terms of Service
Terms and conditions for using KonBid construction estimating software.

1. Acceptance of Terms
By creating an account on KonBid or using the service at app.konbid.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
The Service is a professional tool intended for use by adults in the course of business. You must be at least 18 years old to create an account. The Service is not directed at children, and no one under the age of 13 may use it; if we learn that an account belongs to a child under 13, we will delete the account and its data promptly.
We may update these Terms from time to time. We will update the "Last updated" date at the top of this page when changes are made. If we make a material change to these Terms, we will notify you by email to your account address and/or by an in-app notice at least thirty (30) days before the change takes effect — this includes, without limitation, changes that materially affect your subscription, such as pricing, billing cadence, or cancellation rights. Your continued use of the Service after the effective date of a change constitutes acceptance of the updated Terms.
Currently KonBid is operated by Bryson Williams of Cape Cod, Massachusetts.
2. Description of Service
KonBid is a cloud-based web application that allows construction estimators and general/heavy-civil contractors to build, manage, and export project bids. The service includes:
- Cost Database — a shared, company-wide library of labor, equipment, material, and subcontractor/vendor resources, plus crews and reusable task/assembly recipes built from those resources
- Projects and Estimates — bid opportunities containing one or more estimates with line items, phasing, and configurable markup (overhead, profit, contingency, bond, insurance)
- Change orders tied to won projects
- Takeoffs — upload multi-page PDF construction drawings and perform digital takeoffs, including linear and area measurements, quantity counts, cut/fill volume and grading analysis, with automatic and manual scale calibration (see Section 7 regarding storage and export of uploaded PDF files)
- A fully customizable bid document / PDF export builder, including your company's own letterhead, logo, brand colors, and quote terms
- CSV import and export of cost database and estimate data
- Cloud storage and access from any modern web browser
- In-app support ticket submission for bug reports, feature requests, and general support
The service is provided via web browser and does not require any software installation. Features and availability may change as we improve the product.
3. Subscription, Pricing, and Billing
KonBid is a subscription service, billed per company account. One flat monthly price covers your workspace and everything in it, with no per-estimate, per-project, or per-takeoff charges and no usage metering.
Plan and pricing
KonBid is available at the following price:
- KonBid: $79 USD per month, per company account
All prices are in US dollars and are presented exclusive of tax. Where we are required to collect sales tax, VAT, or other taxes, they are calculated and added by our payment processor at checkout based on the billing address you provide, and shown to you before you confirm the charge. We may introduce additional plans or tiers in the future (such as annual billing, Teams, or Enterprise plans); their availability and pricing will be published on our pricing page.
Free trial
Every new company account begins with a 14-day free trial. No credit card is required to start the trial. During the trial you have full access to the Service. The trial clock starts when the company account is created, and runs for 14 calendar days from that moment. The trial does not automatically convert to a paid subscription. If you take no action when the trial ends, your account moves to a paywalled state as described in Section 12. If you never start a paid subscription, your account and Company Data are subject to deletion beginning three (3) months after your trial ends — see “Trial-only accounts” in Section 12.
Subscribing during your trial
If you start a paid subscription while your trial is still active, your payment method is collected by Stripe but no charge is made until the end of your 14-day trial. The remaining trial time is preserved. The first charge takes place at the moment your trial would have ended naturally. You can cancel before that first charge from your account Settings or the Stripe Customer Portal, and you will not be charged.
Auto-renewal
Paid subscriptions automatically renew each month at the then-current price for your plan, until you cancel. Each renewal charge is made using the payment method on file with our payment processor. See Section 14 for the full auto-renewal disclosure required by certain US state laws.
Cancellation
You may cancel your subscription at any time, with no cancellation fee, through your account Settings or directly through the Stripe Customer Portal. If your workspace is already paywalled — because a payment failed, for example — the same Customer Portal is reachable from the billing screen you land on when you sign in, so cancelling never requires an active subscription or a message to us. Cancellation takes effect at the end of your current billing period. You retain full access until that period ends. After it ends, your account moves to a paywalled state. We do not pro-rate refunds for early cancellation (see Section 15 and the Refund Policy). See “Data retention after cancellation” in Section 12 for how long your data is retained after cancellation.
Price changes
We may change subscription prices for new customers at any time. For customers with an active paid subscription, we will give you at least thirty (30) days advance notice by email and/or in-app notice before any price change applies to your next renewal. Continuing your subscription after the notice period and into the next renewal constitutes acceptance of the new price. If you do not accept the new price, you can cancel before your next renewal and you will not be charged the new amount.
Failed payments
If a renewal charge fails (for example, due to an expired card, insufficient funds, or a bank decline), Stripe will automatically retry the charge using its "Smart Retries" logic over a period of approximately twenty-one (21) days. Stripe, as our payment processor, emails you on our behalf when a charge fails and asks you to update your payment method (see "Email from Stripe" in Section 13). Your account is treated as paywalled (see Section 12) from the moment the charge fails, and stays that way until either the charge succeeds and access is restored, or the retries fully fail. You can settle the outstanding invoice at any point during that window from the billing screen you land on when you sign in, which restores access immediately rather than waiting for the next retry. If all retry attempts fail, your subscription will be canceled. You can update your card and re-subscribe at any time. See “Data retention after cancellation” in Section 12 for how long your data is retained if you do not re-subscribe.
Promotional pricing
From time to time, we may offer promotional pricing for limited windows. Promotional pricing terms are presented at the time of purchase. Where a promotional rate is described as "locked" or "forever," the locked rate applies for as long as your subscription remains continuous. If your subscription is canceled (whether by you, or by us after the dunning retry period described above), the locked rate is forfeit. A new subscription started later will be billed at the then-current standard price.
Coupons and promotional codes
Where offered, coupon codes are subject to the specific terms of each promotion. Coupon codes are not stackable. Some promotional codes are restricted to first-time subscribers or to specific plans and durations as stated in the promotion.
4. User Accounts and Company Workspace
To use KonBid, you must create an account by providing a valid email address and password. Creating an account creates a company workspace for you. You must be at least 13 years of age to create an account, and at least 18 to be the billing owner of a subscription.
Each company workspace is a single tenant with one subscription, and all of its data is isolated from every other workspace. You are responsible for all activity that occurs under your company's account.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or your company's workspace. Each individual account is intended for use by a single person; you may not share your login credentials with others.
You must provide accurate information when creating your account and company workspace, and keep that information up to date.
5. Acceptable Use
You agree not to:
- Upload files containing malware, viruses, or malicious code
- Attempt to gain unauthorized access to the service, other companies' workspaces, other users' accounts, or our infrastructure
- Use the service to store or distribute content that violates any applicable law
- Reverse engineer, decompile, or disassemble any part of the application
- Use automated tools to scrape, crawl, or extract data from the service, including the cost database
- Interfere with or disrupt the service or servers or networks connected to the service
- Circumvent rate limiting, storage limits, or access controls
- Create multiple company accounts to evade restrictions or to abuse free trial periods
- Upload files exceeding size limits or non-PDF files for unintended purposes
- Use the service for any purpose other than its intended use as a construction estimating and takeoff tool
6. Intellectual Property
The KonBid application, including its source code, design, branding, and documentation, is owned by KonBid and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the application without our written permission.
You retain full ownership of the content you upload to or create within the service, including your PDF construction drawings, cost database (resources, crews, and assemblies), estimates, takeoffs, and bid documents. We claim no intellectual property rights over your content.
7. Uploaded Content and Company Data
You retain all ownership rights to the PDF construction drawings, cost database entries, estimates, takeoffs, and other content your company uploads to or creates within KonBid ("Company Data"). By uploading or creating Company Data, you grant us a limited, non-exclusive license to store, process, and serve that content back to you and your authorized company members solely for the purpose of providing the service.
You represent that you have the right to upload any content you provide and that your content does not infringe on any third party's intellectual property or other rights. You are solely responsible for ensuring you have proper authorization to use and upload any construction plans, drawings, or third-party cost data.
Company Data is often commercially sensitive (for example, internal labor rates, vendor pricing, and bid strategy). We do not access, use, or share your Company Data except as necessary to provide, maintain, and support the service, or as required by law. Access to your Company Data within the service is restricted to your own company workspace through per-company access controls.
Uploaded PDF drawings used for Takeoffs
PDF construction drawings that you upload to use with the Takeoffs feature are accepted solely to enable on-screen digital measurement, scale calibration, and related takeoff functionality within the Service. KonBid is not a document management, archival, or plan-storage service, and uploaded PDF files should not be treated as your system of record for construction drawings.
KonBid does not offer, and is not obligated to provide, a mechanism to export or download the original uploaded PDF file through the Service, including as part of the company data export described in Section 12. KonBid does not guarantee the continued availability, integrity, or retention of any uploaded PDF file and is not responsible for storing your PDF drawings on your behalf. You are solely responsible for independently maintaining and backing up your own copies of all PDF drawings, plans, and specifications outside of KonBid before and after upload. In the event any uploaded PDF file is lost, corrupted, deleted, or otherwise becomes unavailable for any reason, KonBid shall have no liability to you, and your sole remedy is to re-upload the file from your own records.
8. Service Availability
We strive to keep KonBid available and running smoothly at all times, but we do not guarantee uninterrupted or error-free service. The service is provided on a "best effort" basis. We may need to take the service offline for maintenance, updates, or other operational reasons.
We are not liable for any loss or damage resulting from service downtime, data loss due to system failures, or interruptions beyond our reasonable control.
9. Estimating Accuracy, Professional Judgment, and Assumption of Risk
KonBid provides tools for digital takeoffs and cost estimating, including measurement tools for construction plans and calculation engines for cost rollups, markup, and bid totals. While these tools are designed to produce accurate results, the accuracy of any measurement or calculation depends on several factors, including the quality of the uploaded PDF, the correctness of scale calibration, the accuracy of the cost data and production rates you enter into your cost database, and the precision of user input.
Estimates and professional judgment
Quantities, cut/fill volumes, and exports produced by the service are estimates derived from your tracing and scale calibration. They are tools intended to assist a qualified estimator and are not a substitute for professional judgment or engineered surveys. You are solely responsible for independently verifying all measurements, quantities, cost data, markup calculations, and bid totals produced using KonBid before relying on them for bidding, construction, contracts, material orders, or any other purpose. KonBid is an estimating and measurement tool, not a substitute for professional judgment. We are not responsible for errors in measurements, cost calculations, estimates, or bids that result from using the service.
Assumption of risk
You acknowledge that construction estimating is an inherently high-risk activity involving significant financial exposure, code compliance, safety considerations, and unpredictable jobsite conditions. You knowingly and voluntarily assume all risk of using the service and its output — including takeoffs, quantities, cut/fill volumes, cost calculations, and exported bid documents (collectively, "Output") — in that context. You represent that you have the professional experience, judgment, and licensing (where required by your jurisdiction or trade) to independently evaluate every Output before use.
10. Limitation of Liability
To the maximum extent permitted by law, KonBid and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the service.
Our total liability for any claims arising from or related to the service shall not exceed the amount your company has paid us during the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless KonBid and its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the service, your violation of these Terms, or your violation of any rights of another party.
12. Termination
You may cancel your subscription at any time through your account Settings or the Stripe Customer Portal. Cancellation takes effect at the end of your current paid billing period. After that period ends — or immediately, if your subscription lapsed because a payment failed or your free trial ran out — your company's workspace moves to a paywalled state.
While paywalled, the estimating application itself is closed. Signing in takes you to a billing screen instead of your dashboard, and you cannot open, view, or edit projects, estimates, takeoffs, drawings, the cost database, or templates, or export bid documents, until you subscribe. From that billing screen you can still:
- Start or restart a subscription, which restores full access to everything immediately
- Settle an outstanding invoice, if your subscription lapsed because a payment failed
- Open the Stripe Customer Portal to update your card, download past invoices, or cancel
- Download a complete copy of your company's data, at any time and as many times as you like (subject to the data retention periods described below)
- Contact us, including to request deletion of your company account and data (see "Account deletion" below)
Your data export
The export is a single file containing all of your company's work: every project, estimate, line item, phase, markup, change order, takeoff and measurement, plus your entire cost database of resources, crews and assemblies, and your templates and bid document presets. As described in Section 7, the export does not include the original uploaded PDF construction drawings used for Takeoffs — KonBid does not offer export or download of uploaded PDF files, and you are responsible for independently maintaining your own copies of those documents. The export is available whether or not you have ever paid us, and we do not charge for it. If your paid subscription has ended, remember that your data is only guaranteed to be retained for three (3) months from the date your subscription ended (see “Data retention after cancellation” below) — generate an export before that window closes if you are not sure whether you will re-subscribe.
Data retention after cancellation
This section applies to accounts that have had at least one active paid subscription. (If your company never subscribed and only used the free trial, see “Trial-only accounts” below.) Once your paid subscription ends — whether because you canceled it, because a renewal charge failed and the retry period described in Section 3 ran out, or because we terminated your account under “Termination by KonBid” below — your company's projects, estimates, takeoffs, uploaded drawings, cost database, and templates remain associated with your company workspace and are guaranteed to be retained for at least three (3) months from the date your subscription ended. If you re-subscribe at any time during that three-month window, your full data is immediately accessible again with nothing lost. Once the three-month window has passed without a re-subscription, we no longer guarantee that your data is retained: it becomes subject to deletion at any time thereafter, at our discretion and without further individual notice, though we may also choose to send a reminder before deleting it. This is why we recommend taking an export (see above) before the three-month window closes if you are not sure whether you will re-subscribe.
Trial-only accounts
If your company completes its 14-day free trial and never starts a paid subscription, your account is treated differently from the lapsed-subscription accounts described above: your account and all of your Company Data — including projects, estimates, uploaded drawings, cost database, and templates — are subject to deletion at any time on or after three (3) months from the date your trial ended. We may delete such trial-only accounts without further individual notice, though we may also choose to send a reminder beforehand. You can generate the data export described above (available whether or not you have ever paid us) at any time before deletion occurs. Deletion under this policy is irreversible once completed. If you start a paid subscription at any point before your account is deleted, this three-month trial deletion policy no longer applies, and the “Data retention after cancellation” terms above govern your account going forward.
Account deletion
KonBid does not currently offer a self-service "delete my account" control inside the product. To delete your company account and all associated data, contact us at [email protected] and request deletion. We will verify that the request comes from an authorized admin of the company workspace, then permanently remove your company's data — including projects, estimates, uploaded PDF drawings, takeoffs, cost database, and templates — from our production systems. This is irreversible and cannot be undone once completed. If your company has an active paid subscription at the time of deletion, the subscription is canceled as part of that process, and no refund is issued for the unused portion of the billing period. Stripe may retain billing records (invoices, transaction history) for up to seven (7) years as required by tax law, even after your company's data is removed from our systems.
Termination by KonBid
We reserve the right to suspend or terminate your account or company workspace if you violate these Terms, engage in abusive behavior, threaten the security or integrity of the service, or repeatedly fail to pay after the dunning retry period described in Section 3. We will make reasonable efforts to notify you before termination unless immediate action is necessary to protect the service or other users. No refunds are issued for terminations that result from your violation of these Terms. If your company had an active paid subscription at the time of termination, see “Data retention after cancellation” above for how long your data is retained afterward.
13. Payment Processing
KonBid uses Stripe (Stripe, Inc.) as its payment processor. When you subscribe to a paid plan, you provide your payment information directly to Stripe through their secure checkout flow. We do not store or process credit card numbers, CVV codes, bank account numbers, or any other sensitive payment data on our servers. Stripe is a PCI-DSS Level 1 certified payment processor.
Subscription billing is managed jointly by KonBid and Stripe:
- Your subscription plan, status, and billing dates are stored in your KonBid account.
- Your payment method, charge history, invoices, and refund records are stored by Stripe.
- The Stripe Customer Portal, accessible from your account Settings, lets you update your card, download invoices, and cancel.
Email from Stripe
Stripe, as our payment processor, sends the following payment-related emails on our behalf:
- Successful payments — a receipt confirming that a charge on your subscription succeeded
- Failed payments — a notice when a charge fails, asking you to update your payment method
- Expiring cards — a notice when the payment method on file is approaching its expiration date
Those three are the payment-related emails Stripe sends for your KonBid subscription. Other billing state — including upcoming monthly renewals, cancellations, and trial endings — is communicated in the product: the billing screen you land on when you sign in, and your account Settings Billing tab. Receipts and past invoices are also available at any time from the Stripe Customer Portal.
Disputes and chargebacks
If you believe a charge was made in error, contact us at [email protected] before initiating a chargeback through your card issuer. We will work to resolve the issue directly and typically respond within two business days. Chargebacks initiated without prior contact may result in the immediate cancellation of your subscription and recovery of disputed amounts through other means.
Tax
Applicable sales tax, VAT, GST, or other tax is calculated by Stripe Tax based on your billing address and the laws of your jurisdiction. The tax amount is shown to you at Stripe Checkout before you confirm the charge. You are responsible for any taxes due on your subscription. If your tax situation changes (for example, you provide a valid tax exemption or VAT registration number after subscribing), contact us and we will work with Stripe to update your tax treatment.
14. Auto-Renewal Disclosure
This section provides additional disclosure of the auto-renewal nature of paid subscriptions, as required by certain US state laws including the California Business and Professions Code Section 17600 et seq. (the "California Automatic Renewal Law"), New York General Business Law Section 527-a, and the Illinois Automatic Contract Renewal Act.
Acknowledgment
You acknowledge and agree that paid KonBid subscriptions are automatically renewing. By starting a paid subscription, you authorize Stripe, on our behalf, to charge your payment method on file for the agreed subscription fee at the start of each monthly billing period, until you cancel.
Cancellation mechanism
You can cancel your subscription at any time with no cancellation fee. Cancellation is at least as easy as the signup process, in compliance with the Federal Trade Commission's "click-to-cancel" guidance. You can cancel through any of the following methods:
- From your KonBid account Settings (Billing tab, then "Manage billing"), which opens the Stripe Customer Portal
- From the billing screen you land on when you sign in to a paywalled workspace, using the "Manage or cancel subscription" button, so that cancelling does not require an active subscription
- By emailing [email protected] and requesting cancellation (we will process your request within one business day)
After you cancel, your access continues through the end of the current paid billing period. No further charges will be made unless you re-subscribe.
Notice of renewal
Because KonBid currently bills on a monthly cadence, we do not send a separate reminder email before each renewal. Stripe emails a receipt after each successful charge (see Section 13); the charge also appears on each billing statement, and you may at any time view your next renewal date on your account Settings Billing tab. If we introduce annual billing in the future, subscribers on an annual plan will receive an email reminder approximately thirty (30) days before their annual renewal date, alerting them to the upcoming charge and the cancellation link.
California residents
Pursuant to California Business and Professions Code Section 17600 et seq., the auto-renewal terms above are presented in clear and conspicuous form. By starting a paid subscription, you affirmatively consent to the auto-renewal of your subscription at the price and cadence disclosed at Stripe Checkout, until you cancel. You may cancel at any time using any of the methods listed above. If you cancel within three (3) business days of a charge that you believe was unauthorized, contact us at [email protected] for assistance.
15. Refund Policy Reference
KonBid does not offer refunds for completed subscription charges. We may, at our sole discretion, issue refunds on a case-by-case basis for legitimate issues such as duplicate charges, account compromise, or charges made after a confirmed cancellation. To request a refund consideration, contact us at [email protected].
16. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your specific requirements or that the results obtained from using the service will be accurate or reliable.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall be resolved in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of such courts.
